Who is responsible for AC leak and mold cost, tenant or management?« Back to Previous Page

The AC in my apartment in Jumeirah Village Circle has been leaking a bit, and now I’ve found black, fuzzy mold spreading on the back of my bedroom wardrobe. It’s been humid for the last few weeks and the smell is getting really strong. Who is responsible for handling this and the cost—is it me as the tenant or the building management?

This is a very common issue here in Dubai, especially during the humid summer months. The responsibility for the cost hinges on the source of the problem, which is defined under UAE tenancy law.

Typically, the AC unit itself, including the internal compressor and the external chiller, is considered part of the landlord's property and therefore their responsibility to maintain. If the leak is originating from a faulty AC drain pan, a cracked condensate line, or a malfunctioning chiller unit, the repair cost for fixing that leak falls squarely on the building management or the property owner. The resulting water damage and mold growth caused by their faulty equipment should also be their financial responsibility to remediate.

However, as a tenant, you have a duty to report issues promptly. If the leak was minor and went unreported for an extended period, leading to significant mold proliferation, you could be held liable for the mold remediation costs due to negligence in reporting. The strong smell and visible spread you describe indicate it's beyond a simple surface clean.

Given the black, fuzzy appearance (which could be Stachybotrys, a concerning toxigenic mold), this is a serious indoor air quality issue. You must formally notify your landlord or property management company immediately in writing, detailing the problem and its suspected link to the AC leak. Do not attempt to clean it yourself with bleach, as this can aerosolize the spores.

We strongly recommend a professional indoor environmental inspection to identify the exact mold species and the full extent of the contamination, which will provide a definitive report for your landlord.
