Who is responsible for AC leak and mold in Dubai rental?« Back to Previous Page

Our AC in the bedroom has been leaking a bit for over a month, and now we're seeing these black, speckled patches spreading on the wall behind the wardrobe. The landlord says it's just humidity and to clean it, but it keeps coming back and my husband's allergies have been terrible. Who is legally responsible for getting this properly inspected and remediated in Dubai, us or the owner?

Based on the Dubai Rental Law (Law No. 26 of 2007) and the terms stipulated in the standard tenancy contract, the responsibility for maintenance and repairs of major building systems, including the central air conditioning (AC) unit and its associated ducting, falls upon the property owner or landlord. An AC leak is considered a structural or mechanical defect that the landlord is legally obligated to rectify.

The black, speckled patches you describe are a clear indicator of microbial growth, likely Stachybotrys chartarum (often referred to as "black mold") or Aspergillus niger, which are common in the UAE due to the high humidity and condensation issues associated with year-round AC use. Your husband's aggravated allergies are a significant health concern, as these molds produce mycotoxins and allergens that can severely impact respiratory health.

Simply cleaning the visible growth is a temporary and ineffective solution. The root cause—the moisture from the AC leak—must be addressed first. The mold has likely penetrated the wall cavity behind the wardrobe, requiring professional remediation to safely remove the contaminated materials and restore a healthy indoor air quality.

You should formally notify your landlord in writing (email is best for a paper trail) of the issue, citing the AC leak and resultant mold growth as a violation of your right to a habitable property. Request immediate, professional inspection and remediation. If the landlord refuses, you can file a complaint with the Rental Dispute Center (RDC) in Dubai.

For a definitive assessment and to protect your health, I strongly recommend a professional mold inspection. Our certified team at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to identify the exact species and extent of contamination, and provide a detailed report for your landlord.
