Who is responsible for AC leak and mold, landlord or tenant?« Back to Previous Page

The AC unit in my bedroom in Deira has been leaking a bit, and now I’m seeing these black speckles spreading on the wall behind the wardrobe. It’s been getting worse since the humidity spiked a couple of weeks ago. My landlord is saying it's from us not ventilating properly, but I run the exhaust fan every time I shower. Who is actually responsible for getting this tested and cleaned, the tenant or the landlord?

Based on the UAE Civil Code and common tenancy contract stipulations, the responsibility for repairs related to the building's structure and fixed systems, such as the air conditioning unit and its condensate drain line, falls squarely on the landlord. The AC leak you describe is a mechanical failure, and the resulting mold growth on the wall is a direct consequence of that failure, not occupant behavior.

While tenants are responsible for general upkeep and ensuring adequate ventilation, your action of running the exhaust fan demonstrates due diligence. The extreme humidity in Dubai, especially during summer months, exacerbates any existing moisture problem but is not the root cause. The primary issue is the leaking AC unit, which is a landlord maintenance obligation.

For a definitive resolution, you must formally notify your landlord in writing about the leak and the proliferating Stachybotrys chartarum (black mold), requesting immediate professional remediation. Do not attempt to clean it yourself, as improper handling can aerosolize toxic mycotoxins.

We strongly recommend a certified mold inspection to assess the full extent of the contamination, both visible and within the wall cavity. This professional report will serve as crucial evidence for your landlord, detailing the source of the moisture and the required scope of remediation.
