Who is responsible for AC leak and mold, me or landlord?« Back to Previous Page

The AC in my bedroom closet has been leaking for a while, and now I've discovered a huge patch of black mold spreading on the wall behind my clothes. My landlord says it's because I don't run the AC enough, but it's been crazy humid lately and I feel like the leak is the main issue. Who is actually responsible for fixing the leak and cleaning this mold, me or the building management?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is fundamentally responsible for maintaining the structural integrity of the property, which includes all permanent fixtures like the air conditioning system and the building envelope. The leak from the AC unit is a maintenance issue for the building owner or management to rectify.

The development of black mold is a direct consequence of this unresolved water intrusion. Dubai's intense humidity and condensation issues mean that any persistent moisture source, especially from an AC drain line or condensate pan leak, will inevitably lead to rapid mold colonization. While tenant behavior, such as significantly underutilizing the AC, can contribute to ambient humidity within the space, it does not absolve the landlord from fixing a faulty appliance that is actively leaking.

Your first step is to formally notify your landlord or property management company in writing about the leak and the subsequent mold growth, giving them a reasonable timeframe to address it. For a "huge patch" of black mold, a professional inspection is non-negotiable. DIY attempts can be hazardous and ineffective, potentially disturbing toxic spores and allowing the problem to regrow.

We strongly recommend you contact a certified professional like Saniservice. Our experts can conduct a comprehensive assessment to identify the exact mold species, the full extent of the contamination, and the precise source of the moisture. This detailed, technical report will be crucial evidence of the required remediation scope and can help definitively establish liability.
