Who is responsible for AC leak and mold, tenant or landlord?« Back to Previous Page

The AC in our bedroom in Jumeirah Village Circle has been leaking a bit, and now we're seeing these black spots spreading on the wall behind the wardrobe. It's been getting worse since the humidity spiked a couple of weeks ago. I've told the landlord, but they said it's from our AC use and we need to handle the cleanup ourselves. Who is actually responsible for fixing the leak and removing this mold, the tenant or the owner?

Based on Dubai's climate and tenancy laws, the responsibility for this AC leak and resulting black mold is typically that of the property owner (landlord). The high humidity and constant AC use in Dubai are well-understood environmental factors that property owners must account for in building maintenance.
The black spots you describe are almost certainly Stachybotrys chartarum or another toxigenic species, accelerated by the moisture from the AC leak and the recent humidity spike. This is a structural issue originating from the air conditioning system, which is a fixture of the property. Under Dubai Law No. 26 of 2007 (as amended), which regulates the relationship between landlords and tenants, the landlord is generally responsible for maintaining the property's structure and essential utilities, including the central AC system and any resultant damage caused by its failure. Your landlord's claim that it is due to your "AC use" is likely unfounded unless they can prove negligent operation that directly caused the mechanical failure. Normal usage is expected, especially during Dubai's summer months. However, immediate action is critical. This type of mold poses significant health risks and can cause extensive property damage. We strongly recommend a professional inspection to identify the exact species, the extent of contamination behind the wardrobe, and the root cause of the AC leak. Do not attempt to clean this yourself, as improper remediation can aerosolize toxic spores and spread the contamination.
