Who is responsible for AC leak mold: tenant or landlord?« Back to Previous Page

The AC in my apartment seems to be leaking a little water onto the wall in the master bedroom, and now I’ve found a patch of black mold spreading behind the wardrobe. I’ve been wiping it with vinegar, but it keeps coming back, and my landlord is saying it’s due to my lack of ventilation and is my problem to fix. Who is actually responsible for the remediation costs for something caused by the AC unit?

Based on the UAE Civil Code and standard tenancy contract provisions, the responsibility for mold remediation in this scenario is complex but generally falls to the landlord. The core issue is the AC unit leak, which is a structural or mechanical defect in the property's provided fixtures. Landlords are legally obligated to maintain the property in a habitable condition, which includes ensuring the proper function of built-in air conditioning systems.

The landlord's claim that lack of ventilation is the primary cause is a common but often incorrect deflection. While ventilation is important in our humid Dubai climate to manage ambient moisture, it does not address an active water intrusion from a faulty appliance. The persistent leak is creating a chronic dampness problem that no amount of tenant ventilation can overcome, as evidenced by the mold's return after your DIY attempts with vinegar. Vinegar is a surface-level treatment and is ineffective at addressing the root moisture problem or removing entrenched mold growth.

We strongly recommend you cease DIY efforts and request a professional mold inspection immediately. A certified inspector can identify the exact species of mold, the extent of the contamination behind the wardrobe, and definitively trace the moisture source to the AC leak. This technical report is crucial evidence for formally disputing the landlord's claim.
