Who is responsible for AC mold: tenant or landlord?« Back to Previous Page

The AC in my bedroom closet has been leaking a bit, and now I’ve discovered a patch of black mold spreading on the back wall. My landlord says it’s because we don’t run the AC enough, but we live in a studio in Jumeirah and it’s on 24/7. Who is legally responsible for the inspection and cleanup here, the tenant or the building owner?

In the UAE, the legal responsibility for mold remediation stemming from an AC leak typically falls upon the building owner or landlord, not the tenant. This is governed by Dubai Law No. 26 of 2007, known as the 'Real Estate Regulatory Law' and its amendments, which stipulate that the landlord is responsible for maintaining the property's core structure and essential services, including the central air conditioning system and its components.

The landlord's argument that the issue is due to insufficient AC operation is not valid in a studio apartment in Jumeirah. The Dubai climate, characterized by extreme humidity and high temperatures, necessitates year-round AC use to manage moisture and prevent condensation. A leak from the AC unit itself is a mechanical failure, indicating a problem with the drainage line, insulation, or installation. This is a maintenance issue under the landlord's purview.

However, tenants have a responsibility to report issues promptly and allow access for repairs. The presence of black mold (Stachybotrys chartarum or other toxigenic species) indicates a persistent moisture problem and poses a health risk. This situation requires immediate professional intervention. DIY cleaning is insufficient and can exacerbate spore dispersal.

We strongly recommend a certified mold inspection to identify the moisture source, assess contamination levels, and provide a scope for professional remediation. Our team at Saniservice uses thermal imaging, moisture meters, and air/surface sampling to deliver a comprehensive report, which can be crucial for discussions with your landlord regarding responsibility and necessary repairs.
