Who is responsible for black mold cleanup, tenant or landlord?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold that’s been spreading on the ceiling of our master bedroom in Deira. Our landlord says it’s our fault for not running the AC enough, but we keep it at 24 and it’s been there since the humidity spike last month. Who is actually responsible for the cleanup and cost of fixing this, the tenant or the landlord?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for the structural integrity and maintenance of the property, including issues arising from inherent building defects or faulty infrastructure. The black mold growth on your ceiling in Deira is a classic symptom of a condensation issue, often caused by inadequate insulation or a malfunctioning HVAC system—both of which are the landlord's responsibility to rectify.

While tenants are responsible for general upkeep, such as regularly running the AC to manage humidity, your setting of 24°C is entirely reasonable for Dubai's climate. The persistent high humidity and the fact the mold appeared after a known humidity spike strongly indicate an underlying structural or mechanical fault, not tenant negligence.

For a definitive determination of the cause and to establish liability, a professional inspection is critical. Our certified mold inspectors at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to identify the precise source of the moisture intrusion. This official report is vital evidence to formally present to your landlord, demonstrating the issue is beyond simple tenant maintenance.

Do not attempt to remove significant black mold yourself, as improper remediation can aerosolize harmful spores. For a professional inspection and a definitive report to resolve the liability issue with your landlord, please call us at 800-MOLDS or email hello@saniservice.com.
