Who is responsible for black mold from an AC leak?« Back to Previous Page

The AC in my apartment seems to be leaking a bit, and now I’ve found a patch of black mold about the size of my hand on the wall behind the bedroom wardrobe. I wiped it with bleach but it came right back in a few days. Who is responsible for fixing the root cause and paying for the remediation, me or my landlord in Dubai?

Based on Dubai's rental law (Law No. 26 of 2007) and the standard tenancy contract (Ejari), the responsibility for this issue is typically divided between tenant and landlord.
The landlord is fundamentally responsible for the maintenance of the property's structure and key systems, including the central air conditioning system and its components. The AC leak is the root cause, and repairing the chiller unit, fixing the condensation drain line, or addressing the leak itself falls under their obligation. This is considered a major maintenance item essential for preserving the integrity of the building. However, as the tenant, you have a responsibility to report issues in a timely manner and to maintain the property in a clean and habitable condition. The act of wiping the mold with bleach was a temporary measure but not a remediation. Bleach is ineffective on porous surfaces like drywall as it only removes the surface discoloration without addressing the hyphae (root structure) deep within the material, which is why the mold returned. Given the climate in Dubai, with extreme humidity and year-round AC use, moisture issues must be addressed immediately to prevent rapid mold regrowth and potential health impacts. The wall itself may now require professional remediation. I strongly recommend you formally notify your landlord or property management company in writing about both the AC leak and the mold recurrence immediately. For a proper assessment of the infestation's extent and to provide a professional report for your landlord, a certified mold inspection is crucial. Our team at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to determine the full scope and provide a definitive remediation protocol. Do not delay, as the situation will only worsen. For immediate assistance, please call 800-MOLDS (800-66537) or email hello@saniservice.com. |
