Who is responsible for black mold from possible AC leak?« Back to Previous Page

The wall behind the wardrobe in my bedroom in our Marina apartment has a large patch of black mold, which we only found when we moved the furniture to clean. It's been humid for the last couple of months and the AC drip from the unit in the hallway might be the cause. Who is responsible for fixing this and the cost of repainting, us as tenants or the landlord?

Based on the scenario you've described in your Marina apartment, determining responsibility hinges on identifying the root cause, which is a critical first step under UAE tenancy law.

The persistent humidity we experience in Dubai, combined with a potential AC condensate drain leak, creates a perfect environment for mold growth. The landlord is unequivocally responsible for the structural integrity of the building and the maintenance of fixed installations, which includes the central AC system and its drainage lines. If the mold is a direct result of a faulty AC drainpipe leaking moisture into the wall cavity, the repair of the leak, any associated structural drying, and the mold remediation itself are the financial responsibility of the landlord. The repainting would also fall to them to restore the wall to its original condition.

However, tenant responsibilities (Law No. 26 of 2007) include maintaining adequate ventilation to prevent condensation. If the mold is solely due to a lack of air circulation behind the wardrobe—a common issue in our climate—the cost of cleaning and repainting could be argued as the tenant's duty.

Given the technical nature of this diagnosis, a professional inspection is mandatory. Our certified inspectors at Saniservice use moisture meters, thermal imaging cameras, and air quality tests to definitively pinpoint the moisture source. This objective report is crucial evidence for discussing liability with your landlord or building management.

Do not attempt to clean significant mold growth yourself, as improper handling can aerosolize spores and exacerbate the problem. For a definitive assessment and to ensure the remediation is handled safely and effectively, I recommend you contact our team for an inspection.
