Who is responsible for black mold from the AC?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for 2 years and just noticed a patch of black mold spreading from the corner of the bedroom ceiling. The AC unit is right above it and it's been working overtime with all the humidity lately. Who is responsible for dealing with this, the landlord or me as the tenant, and what's the first step I should take?

In Dubai, the landlord is typically responsible for addressing structural issues that cause mold, including problems with the AC unit or building envelope that lead to condensation and moisture accumulation. As the tenant, your responsibility generally covers reporting the issue promptly and maintaining good ventilation to prevent it from worsening.
Your first step is to formally notify your landlord or property management company in writing, with clear photos of the mold and its location relative to the AC unit. This creates a necessary paper trail. The persistent humidity here causes AC drain pans and insulation to constantly sweat, and a clogged condensate drain line from the unit directly above is a very common culprit for ceiling leaks and mold in bedrooms. While waiting for a response, avoid disturbing the mold and ensure the room is well-ventilated. For a patch that is actively spreading, a professional inspection is advised to identify the exact moisture source—whether it's a faulty AC installation, inadequate insulation, or a leak from above. The inspection can determine the scope of repairs needed, which the landlord should arrange. If the landlord is unresponsive, you can reference Dubai's rental law (Law No. 26 of 2007) which mandates the landlord's responsibility to maintain the property in a habitable condition. |
