Who is responsible for black mold in a rental property?« Back to Previous Page

My kids have been coughing nonstop since the heavy rains in Al Quoz last month, and I just found a huge patch of black mold behind our bedroom wardrobe. The landlord says it’s our fault for not ventilating properly, but the AC unit in that room has been leaking for ages. Who is legally responsible for the inspection and cleanup in a rental, us or the property owner?

In the UAE, specifically Dubai, the legal responsibility for mold remediation in a rental property is primarily governed by the rental contract and Dubai Law No. 26 of 2007, known as the 'Regulating Relationship between Landlords and Tenants in the Emirate of Dubai Law'.

Typically, the property owner (landlord) is responsible for maintaining the structural integrity of the building and the proper functioning of all fixed installations, which includes the central AC system and its drainage. If the AC unit has been leaking, as you describe, this constitutes a maintenance issue for the landlord. The resulting moisture intrusion, exacerbated by our high humidity and condensation issues, is the direct cause of the mold growth. Your responsibility as a tenant is generally limited to reporting such issues in a timely manner and ensuring adequate daily ventilation.

The health implications for your children are a serious concern. Persistent coughing is a classic symptom of exposure to mycotoxins from mold species like Stachybotrys chartarum (black mold). This necessitates immediate professional intervention.

Do not attempt to clean a significant patch yourself, as improper remediation can aerosolize spores and worsen the contamination. You require a certified mold inspection to identify the species, spore count levels, and the full extent of the infestation, including inside the AC unit and behind walls.

We strongly advise you to formally notify your landlord in writing of the leaking AC and the consequent mold issue, citing your concerns for health and property. Request immediate professional remediation. For a comprehensive assessment and to understand your legal standing, we recommend contacting our specialists at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com for a professional inspection and detailed report that can be used to liaise with your property owner.
