Who is responsible for black mold in my rental apartment?« Back to Previous Page

We've lived in our Marina apartment for 2 years and just noticed a huge patch of black mold spreading from the corner of the bedroom ceiling, right behind the wardrobe. It definitely wasn't there during the last inspection and I'm worried it's from a slow leak. Who is responsible for getting this fixed and paying for it, me or the landlord, especially if it's causing a health issue?

In the UAE, the responsibility for mold remediation in a rental property is primarily determined by the cause of the moisture, as outlined in standard tenancy contract terms and Dubai Law No. 26 of 2007 (as amended).
If the black mold is a result of a structural issue, such as a leaking central AC duct within the ceiling void, a faulty seal on the building envelope, or a leak from an adjacent apartment, the financial responsibility for the investigation and repair falls to the landlord or building management. The landlord is obligated to provide a property that is habitable and maintained in good condition. However, if the moisture source is determined to be tenant-related, such as insufficient use of air conditioning leading to extreme condensation, blocking ventilation grilles with furniture, or localized spills that were not addressed, the tenant would typically be responsible for the cost of cleaning and remediation. The unique climate in Dubai, with its extreme humidity, necessitates the constant and proper use of AC to manage indoor humidity levels and prevent condensation, which is a primary catalyst for mold growth. Given that the mold is extensive, behind a wardrobe, and on the ceiling, a professional inspection is critical. This is not a surface cleaning issue. A certified mold inspector can conduct moisture mapping and air quality testing to definitively identify the source of the moisture—whether it's an active leak or condensation—and provide a detailed report. This report is essential evidence for determining liability with your landlord. For a definitive diagnosis and to discuss your specific case, I strongly recommend contacting our specialists at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule a comprehensive inspection. Our detailed report will clearly outline the cause and necessary corrective actions, which you can then present to your landlord or building management. |
