Who is responsible for black mold repair cost in a rental?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years and just noticed a patch of black mold in the corner of our master bedroom closet, behind some boxes. It seems to have spread a bit since I first spotted it a couple of weeks ago, and I'm worried it's from a hidden leak in the wall. Who is responsible for dealing with this and the cost of repairs – me as the tenant or the building management/landlord?

Tenant-landlord responsibility for mold in Dubai rentals depends on the source of the moisture. The general rule under Dubai rental law (Law No. 26 of 2007) is that the landlord is responsible for the structural integrity of the property, while the tenant is responsible for maintaining its internal condition.
If the mold is a result of a structural issue—like a hidden pipe leak inside the wall, a leaking AC condensation line, or poor building envelope waterproofing that allows dampness to seep in—then the landlord is typically responsible for the repair and remediation costs. You must notify them in writing immediately. If the mold is due to tenant-related causes, such as inadequate ventilation, failing to use the AC which leads to condensation buildup, or placing wet items in a closet, then the cost of cleaning would fall to you. In humid climates like Dubai's, where AC is essential for controlling moisture, simply not running it can cause mold to form on walls and in closets. Given your description of it being behind boxes in a closet and spreading, a hidden leak is a strong possibility. Document the mold with photos and dates to show its progression. Your first step is to formally notify your landlord or property management company. They should arrange for a professional inspection to identify the moisture source. Do not attempt to clean it yourself until the root cause is fixed, as it will simply return. A proper inspection can determine responsibility and prevent further damage to the property. |
