Who is responsible for black mold repair cost: tenant or management?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a bunch of black, fuzzy spots spreading on the wall behind our wardrobe. It must have been hidden there for a while, and the recent humidity has definitely made it worse. Who is responsible for dealing with this and the cost of repairs – is it me as the tenant or is it the building management's problem?

The responsibility for mold repair costs in a Dubai apartment is typically determined by the cause, as outlined in standard tenancy contracts and the Dubai Land Department's rental law.

If the mold is due to a structural issue from the building itself, such as a leaking central AC condensation pipe within the wall, a faulty external seal allowing water ingress, or a construction defect, the building management or landlord is responsible for the repairs. This includes fixing the source of the moisture and the resultant damage.

If the mold is a result of tenant behavior, the cost falls to you. In the UAE's humid climate, common tenant-caused issues include poor ventilation (not using bathroom exhaust fans), overfilling wardrobes against exterior walls restricting airflow, or setting the AC temperature too high, leading to excessive condensation. The hidden location behind the wardrobe suggests a persistent humidity issue, which could be argued either way.

Your first step is to formally notify both your landlord and building management in writing, with photos. They should arrange a joint inspection to identify the moisture source. For a case this advanced, a professional inspection with moisture mapping and possibly lab testing is strongly recommended to definitively identify the cause. This objective evidence is crucial for resolving liability disputes. Do not attempt to clean significant black mold yourself, as disturbing it can spread spores.
