Who is responsible for black mold, tenant or landlord?« Back to Previous Page

We've lived here for 2 years and just noticed a big patch of black mold behind our wardrobe in the master bedroom, which is on the exterior wall facing the marina. It's gotten worse since the recent humidity spike, and my wife's allergies have been terrible. Who is responsible for handling this and the cost, us as tenants or the landlord?

In the UAE, particularly in high-humidity coastal areas like the Marina, responsibility for mold is determined by the cause. The recent humidity spike is a key factor. Landlords are generally responsible for the structural integrity of the property. If the mold on your exterior wall is a result of a structural issue like water infiltration through cracks, faulty seals around windows, or a leaking pipe within the walls, the repair and remediation cost falls on the landlord.
However, tenant responsibilities are outlined in Law No. (26) of 2007, known as the Dubai Rental Law. Tenants are obligated to maintain the property and are liable for damages resulting from misuse or negligence. If the mold growth is solely due to tenant behavior—such as insufficient use of air conditioning leading to condensation, blocking ventilation, or failing to report a minor leak promptly—you could be held responsible for the cleanup costs. Given its location on an exterior wall behind furniture, this strongly suggests an underlying moisture issue related to the building envelope, which is typically the landlord's domain. The recent exacerbation confirms it's an environmental and structural humidity problem. We strongly advise against DIY removal, especially with black mold and pre-existing allergies. Disturbing it releases spores, worsening air quality and health effects. The first step is a professional inspection to identify the precise moisture source. At Saniservice, our certified inspectors use thermal imaging and moisture meters to diagnose the root cause and provide a definitive report on liability. This evidence is crucial for discussions with your landlord or property management.
