Who is responsible for ceiling leak repair in a rental?« Back to Previous Page

The paint on the ceiling of our master bedroom in Jumeirah Village Circle has started to peel and there's a small brownish stain that's been slowly growing since the last rains. My landlord says it's not a major issue, but I'm worried it's a leak that needs proper fixing. Who is responsible for getting a certified contractor to assess and repair this kind of damage in a rental, me or the landlord?

In the UAE, specifically under Dubai's Law No. 26 of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended), the responsibility for structural repairs, including those resulting from water leaks from the ceiling, falls squarely on the landlord. This encompasses the building's main structure, such as the roof, external walls, and central AC systems if they are the source. The paint peeling and brownish stain you describe in JVC are classic indicators of an active water intrusion, likely from a roof leak or a compromised sealant from the last rains.

The landlord's assertion that it's not a major issue is a significant concern. A slow leak can lead to hidden mold growth within the ceiling void, which can severely impact indoor air quality and pose health risks. It is absolutely not just a cosmetic problem.

You are not responsible for sourcing the contractor; the landlord is obligated to engage a competent service provider to properly diagnose and remediate the issue. However, for your own protection and to ensure the repair is done to a high standard, I strongly recommend you insist on a certified assessment. A professional inspection by a company like ours can identify the exact moisture source, extent of damage, and any potential mold contamination, providing a certified report that you can present to the landlord. This objective evidence is crucial.

If the landlord remains uncooperative, you may need to escalate the matter to the Rental Dispute Settlement Centre in Dubai. For a professional inspection to document the issue, call 800-MOLDS or email hello@saniservice.com.
