Who is responsible for closet mold: tenant or landlord?« Back to Previous Page

Our master bedroom closet in our Jumeirah Village Triangle apartment has started to get these black speckles on the back wall, and it's been getting worse since the humidity spiked a couple of weeks ago. My landlord is saying it's because we don't run the AC enough, but we keep it at 24 when we're out. Who is actually responsible for getting this cleaned and treated, us or the landlord?

Based on Dubai's climate and tenancy laws, the responsibility for mold remediation often hinges on the source of the moisture. The black speckles you describe are a classic indicator of active mold growth, almost certainly fueled by the high ambient humidity.
In the UAE, the landlord is typically responsible for addressing issues related to the building's structural integrity and the proper functioning of installed systems, including the Air Conditioning. If the mold is a result of inadequate insulation in the external wall, a leaking pipe within the structure, or an AC system that is not effectively dehumidifying the air (as per Dubai Municipality standards), then the remediation cost falls to the landlord. Their argument about AC usage is partially valid; air conditioning is essential for humidity control here. However, 24°C is a reasonable temperature setting and should not, by itself, cause significant condensation if the AC unit is functioning correctly and the space is properly sealed. As the tenant, your responsibility is to use the property in a way that prevents avoidable damage, which includes ventilating areas and using the AC to manage humidity. The persistent growth suggests an underlying issue beyond normal occupancy. We strongly recommend a professional inspection to determine the exact cause. Our certified inspectors use moisture meters and thermal imaging cameras to identify the source of the moisture conclusively. This evidence-based report is crucial for determining liability under Dubai rental laws.
