Who is responsible for fixing a leak and mold?« Back to Previous Page

The AC in my apartment seems to be leaking into the wall behind it in our master bedroom, and now there's a huge patch of black mold spreading from the corner. We first noticed a damp spot a couple of weeks ago, but our landlord is saying we should handle the cleanup ourselves since we live here. With the humidity lately, it’s just getting worse every day. Who is actually responsible for fixing the leak and paying for the professional mold removal, me or the landlord?

Your landlord is legally responsible for fixing the leak and the resulting mold removal under UAE tenancy law, as this is a structural maintenance issue. The leak originates from the AC unit, a fixture they are obligated to maintain, and the resulting water damage is not due to your actions.

For documented proof, you can reference Article 16 of Law No. 26 of 2007, which states the landlord must undertake maintenance for the property’s structure, including major installations like central AC systems. Inform your landlord in writing (email is best) with clear photos of the leak and mold, requesting immediate repair to prevent further property damage and potential health risks from the mold spores.

Given Dubai's high humidity, this mold will continue to spread rapidly without addressing the moisture source. Do not attempt removal yourself, as disturbing extensive black mold can aerosolize harmful spores. A professional inspection is needed to assess the full extent behind the wall and perform safe, contained remediation. The landlord should cover all costs for the leak repair, mold assessment, and remediation. If they refuse, you can file a formal complaint with the Rental Dispute Settlement Center in Dubai.
