Who is responsible for fixing a moldy wall frm AC leak« Back to Previous Page

The AC in my apartment in Jumeirah Village Circle has been leaking a bit, and now we have a patch of black mold spreading on the bedroom wall behind the wardrobe. It’s been getting worse over the last couple of weeks. Who is responsible for fixing this and paying for the mold removal—me as the tenant or my landlord?

Responsibility typically falls to the landlord for repairs stemming from the building's structure or fixed appliances like the AC unit and its condensate drain line. Your first step is to notify the landlord or property management company in writing immediately, detailing the leak and mold growth, and include clear photographs.

Under Dubai rental law (RERA), landlords must maintain the property in a habitable condition, which includes addressing issues that cause health hazards like mold. However, if the leak resulted from a tenant's negligence, such as failing to report a minor issue that escalated, liability could be shared. Given Dubai's high humidity, mold from an AC leak can spread rapidly behind furniture, so prompt action is critical.

For a case this advanced, a professional inspection is advised to assess the wall's moisture content and mold penetration. Remediation involves fixing the leak at its source, then properly containing and removing the affected building materials to prevent spore dispersal. Simply cleaning the surface is insufficient. A company with a microbiology lab can provide a clearance test post-remediation to confirm the mold has been resolved and the air quality is safe.
