The AC in our bedroom in Deira has been leaking a bit for a while, but now I’ve pulled back the corner of the carpet and found a huge patch of black mold underneath. The landlord is saying it's our fault for not reporting the leak sooner, but we only just discovered it. Who is legally responsible for fixing this and the mold remediation, us or the owner?

Under UAE law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the landlord is generally responsible for the maintenance of the property's structure and key systems, including the AC and its associated drainage. The leak itself is a structural/mechanical failure, making its repair the landlord's obligation.

However, the tenant is responsible for reporting issues in a timely manner. The dispute will hinge on whether you can demonstrate the leak was a hidden defect you couldn't have reasonably discovered earlier. Since you found it under the carpet, this strengthens your position that it was not immediately visible. Document everything: take clear photographs and videos of the leak source, the extent of the mold, and any correspondence with the landlord.

For a leak of this magnitude, professional remediation is strongly advised. The Dubai climate means hidden mold can proliferate rapidly behind walls and under floors, posing indoor air quality risks. A proper inspection involves moisture mapping and often air or surface sampling to determine the full extent. Remediation requires physical removal of contaminated materials (carpet, padding, possibly drywall) and HEPA vacuuming, not just surface cleaning.

Formally notify your landlord in writing (email is best) about the leak and the subsequent mold discovery, requesting immediate repairs and remediation. If they refuse, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. They will appoint a court-appointed expert to inspect the property and determine liability based on the evidence.
