Who is responsible for mold behind a wardrobe?« Back to Previous Page

The wall behind the wardrobe in our master bedroom in Jumeirah Village Circle has a bunch of black spots that have gotten way worse since the humidity kicked in last month. We've been wiping it down but it just comes back. Our landlord is saying it's our fault for not ventilating properly, but we run the AC constantly. Who is actually responsible for fixing something like this, the tenant or the landlord?

The landlord is typically responsible for fixing mold caused by structural or maintenance issues, like inadequate insulation or a leaking pipe within the wall. However, if the mold is solely due to tenant behavior, like blocking ventilation or failing to use the AC, that responsibility can shift.
In Dubai's climate, constant AC use is standard, but it must be paired with proper ventilation to manage humidity. The recurring mold behind a wardrobe is a classic sign of condensation buildup, often from an exterior wall that isn't properly insulated against our high outdoor humidity. Simply wiping it treats the symptom, not the cause. Your first step should be a formal, written notification to the landlord or property management company, requesting a professional inspection to identify the moisture source. This is crucial, as Dubai's tenancy laws generally hold landlords accountable for maintaining the property's structure. A certified mold inspector can use moisture meters and thermal imaging to determine if the wall has a hidden leak or if it's a condensation issue due to the temperature differential from the AC. If the inspection confirms the building envelope is at fault, the landlord should arrange and pay for the remediation and repairs. If the issue is deemed due to lack of ventilation in that specific spot, you may need to discuss a solution, like repositioning the furniture. Do not attempt to remediate it yourself, as improper handling can spread spores. A professional assessment provides the evidence needed to clarify responsibility. |
