Who is responsible for mold behind bedroom wardrobe?« Back to Previous Page

The wall behind our bedroom wardrobe has these huge black splotches of mold that we just discovered while deep cleaning. We’ve been in this Jumeirah Village Circle apartment for almost a year, and the AC unit in that room has always dripped a little, but now the wall is actually soft to the touch. Who is responsible for fixing this and paying for the mold removal, us or the landlord?

Based on the description of a soft wall and significant black mold growth behind the wardrobe, this is a serious structural and health issue that requires immediate professional attention. The constant dripping from the AC unit is the clear source of moisture, which, combined with Dubai's high ambient humidity and year-round AC use creating condensation, provides the perfect environment for aggressive mold proliferation.

In the UAE, the responsibility for remediation typically falls on the property owner (landlord). According to standard rental contract law (Law No. 26 of 2007), landlords are obligated to provide a habitable property and are responsible for rectifying defects in the main structure of the building, including issues arising from faulty installations like AC systems. The moisture intrusion from the AC unit, which has damaged the structural integrity of the wall (making it soft), is a maintenance issue for the landlord to address. You should formally notify your landlord or property management company in writing immediately, detailing the issue and including photographs. They are generally responsible for the cost of the mold remediation and repairing the wall and AC unit.

However, due to the advanced state of decay ("soft to the touch"), this is not a DIY cleaning task. The mold growth is likely extensive within the wall cavity. Disturbing it without proper containment can aerosolize toxic spores throughout your apartment. A certified mold inspection is critical to assess the full extent of the damage, identify the exact species of mold, and create a scope of work for proper remediation.

For a definitive assessment and to ensure the remediation is handled safely and effectively, I strongly recommend you call our specialists at Saniservice. We can provide a comprehensive inspection and a formal report, which can be invaluable in discussions with your landlord.
