Who is responsible for mold by the AC vent?« Back to Previous Page

We've lived in our Jumeirah Village apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling, right near the AC vent. It’s gotten much worse since the humidity spiked last month. Who is responsible for getting this tested and cleaned – me as the tenant or my landlord?

Responsibility for mold remediation in a rental property is typically defined by the tenancy contract and Dubai Law No. 26 of 2007 (as amended). The landlord is generally responsible for the property's structural integrity and maintenance of fixed systems, including the AC unit and its condensate drain line—a common source of the moisture causing ceiling mold. The tenant is responsible for reporting issues promptly and maintaining reasonable cleanliness and ventilation.
Given the location near the AC vent, the primary cause is likely a blocked condensate drain pan or pipe, an insulation issue allowing condensation, or a leak in the ductwork. This is a maintenance problem. You should formally notify your landlord or building management in writing immediately, as delays can lead to further property damage. Include clear photos showing the progression. In Dubai's high humidity, this type of growth is common and requires professional diagnosis. A proper inspection should identify the moisture source—simply cleaning the visible mold will not prevent its return if the underlying AC issue isn't fixed. For verification, a certified mold assessment, including air and surface sampling analyzed by an accredited microbiology lab, can confirm the species and scope. This documented evidence is often necessary to clarify responsibility with the landlord. If the landlord is unresponsive, you may file a case with the Rental Dispute Center in Dubai. |
