Who is responsible for mold cleanup in a Dubai rental?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found behind the wardrobe in our master bedroom in Jumeirah. It’s been getting worse since the humidity spiked a couple of weeks ago. I’ve told my landlord, but he says it’s our fault for not ventilating the room properly. Who is legally responsible for the cleanup and mold remediation in a rental here, the tenant or the owner?

Based on the Dubai Rental Law (Law No. 26 of 2007) and subsequent regulations, the responsibility for structural maintenance and issues arising from the property's condition, such as mold due to inherent faults, falls squarely on the landlord.

Your situation is a classic example of this. The humidity spike you mentioned is a key factor. Dubai's climate, with its high humidity levels, especially during summer and transitional periods, leads to significant condensation. This is often exacerbated by year-round air conditioning, which can create cold surfaces where moisture condenses if the AC system is not properly balanced or if there are insulation flaws within the building's structure. A hidden mold growth behind a large piece of furniture like a wardrobe is frequently indicative of a pre-existing condensation issue or a hidden water leak within the wall, which are structural problems. While tenants are responsible for general day-to-day cleanliness and ensuring adequate ventilation, the landlord is legally obligated to address the root cause.

Given that your children are exhibiting respiratory symptoms like coughing, this is a serious health concern that requires immediate professional attention. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize spores and exacerbate the problem.

We strongly recommend you formally request a professional mold inspection to identify the exact species and the moisture source. Our certified inspectors at Saniservice use thermal imaging and moisture meters to pinpoint the origin of the problem, which is crucial for determining liability and implementing an effective remediation plan.
