Who is responsible for mold cleanup, landlord or me?« Back to Previous Page

My kids have been coughing nonstop for the past few weeks and we can't figure out why. I finally pulled our sofa away from the wall in the living room and found a huge patch of black mold spreading behind it, probably from a hidden AC condensation leak. We're in an older building in Deira and I'm panicking about their health.
Is this kind of mold definitely the cause of their coughs, and who is responsible for the cleanup here, me or the landlord?

Black mold exposure can absolutely cause persistent coughing, especially in children who are more sensitive. The constant irritation from airborne spores is a common trigger for respiratory symptoms like the ones you're describing.
In Dubai's rental properties, responsibility typically depends on the source of the moisture. Since this appears to be from a hidden AC condensation leak, it is almost certainly the building's structural system and therefore the landlord's responsibility to fix. The landlord is obligated to provide a habitable property under UAE tenancy law, which includes addressing issues like plumbing or AC leaks that cause mold. You are responsible for informing them of the issue in writing immediately. For now, limit your children's exposure to the area and avoid disturbing the mold, as this will release more spores. A professional inspection is crucial to identify the exact moisture source—often a clogged drain line or faulty insulation in our humid climate—and assess the full extent. Proper remediation involves fixing the leak first, then safely removing the contaminated materials, not just wiping the surface. For a situation of this size, a certified remediation company should handle it to ensure it's done correctly and to provide documentation for your landlord. |
