Who is responsible for mold from a hidden leak?« Back to Previous Page

We’ve lived in our Jumeirah Village Circle apartment for 2 years and just noticed a patch of black mold in the corner of our master bedroom closet. It's on the wall itself, not our clothes, and seems to be growing from the inside out, probably from a hidden leak. Our landlord is saying it's our fault for not ventilating properly.
Who is legally responsible for the mold remediation and fixing the potential leak in this case, the tenant or the landlord?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for the structural integrity of the property. This includes the internal plumbing and waterproofing systems. A hidden leak within the wall cavity constitutes a structural defect, making the landlord legally obligated to address both the source of the leak and the resulting mold contamination.
The landlord's claim about ventilation, while a common point of contention, is unlikely to absolve them of responsibility in this specific scenario. While tenant negligence (e.g., failing to use AC, blocking vents, creating excessive moisture) can be a factor for surface condensation, it does not apply to mold growth originating from a concealed plumbing leak. The persistent moisture from a leak will create a mold problem regardless of ventilation habits, especially in Dubai's humid climate where AC systems are essential for controlling ambient moisture. We strongly recommend you do not attempt to clean this yourself. Disturbing the mold can aerosolize harmful spores. A professional inspection is critical to definitively identify the moisture source using tools like thermal imaging and moisture meters, assess the full extent of the mold growth behind the wall, and provide a legally admissible report for your landlord.
