Who is responsible for mold from landlord's leaking AC?« Back to Previous Page

The AC in my bedroom has been leaking a bit onto the carpet for the past couple of months, and now I've found a large patch of black mold behind my headboard. I've told my landlord, but he says fixing the AC unit is his responsibility, while cleaning the mold is mine because it's "inside" the apartment. Who is actually responsible for the mold remediation in this case?

The landlord is responsible for both fixing the AC leak and the resulting mold remediation. Under UAE tenancy law, the property owner is obligated to maintain the premises in a habitable condition, which includes addressing structural issues and failures of provided appliances like AC units that lead to health hazards. Mold growth is a direct consequence of their appliance's malfunction, not tenant negligence.

The persistent humidity and condensation from a leaking AC unit create a perfect environment for mold in Dubai's climate. Simply cleaning the visible patch is insufficient; the moisture source must be fixed and the affected area professionally treated to prevent regrowth and potential health issues from airborne spores.

For this situation, document everything with photos and formally notify the landlord in writing of both the AC leak and the mold, reiterating that the mold is a direct result of the unrepaired leak. If they remain uncooperative, you can reference the Dubai Land Department's (DLD) regulations and, if necessary, file a complaint through the Rental Dispute Center (RDC). A professional inspection and lab test can definitively link the mold to the water damage, providing concrete evidence for your case.
