Who is responsible for mold inspection in my apartment?« Back to Previous Page

The AC in my apartment seems to be making this weird damp smell that's gotten worse over the summer, and I just found some black spots along the edge of the vent in the master bedroom. We’ve been in this Discovery Gardens studio for about a year, and the landlord is saying it's our fault for not running the AC enough. Who is actually responsible for arranging and paying for a proper mold inspection here?

Based on Dubai's climate, where high humidity and year-round AC use are the norm, condensation within AC units is a primary cause of mold growth. The presence of a damp smell and visible black spots on the vent are strong indicators of microbial contamination within the ductwork or evaporator coil.

Under UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for maintaining the property's main systems, including central air conditioning, falls upon the landlord. They are obligated to ensure the property is habitable and free from defects that affect your health and safety. Mold resulting from inadequate maintenance of the building's AC system, pre-existing dampness, or structural issues is typically the landlord's responsibility. Your duty as a tenant is primarily to use the property appropriately and report issues promptly, which you have done. A landlord claiming that not running the AC enough caused the problem is often an attempt to shift responsibility; continuous AC operation can actually increase moisture accumulation if the unit is not properly maintained or sized for the space.

For a definitive determination of responsibility and the scope of contamination, a professional inspection is essential. Our certified technicians conduct a comprehensive assessment including visual inspection, moisture mapping, and air/surface sampling to identify the mold species and the exact moisture source. This professional report is crucial for liaising with your landlord and establishing liability.

Do not attempt to clean this yourself, as disturbing the mold can aerosolize spores. For a proper inspection and detailed report to present to your landlord, I recommend you contact our team at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule a survey.
