Who is responsible for mold near my AC unit?« Back to Previous Page

We've lived in our Jumeirah Village apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling, right near the AC unit. It’s gotten worse since the humidity spiked last month. Who is responsible for getting this tested and cleaned, me or my landlord, and what’s the process for getting them to fix it properly?

Landlord responsibility for mold remediation depends on the cause. In Dubai rentals, the landlord is generally responsible for fixing the building's structure and main systems, like AC units and leaks that cause condensation. You are responsible for issues due to your own negligence or lack of ventilation.
Since the mold is near the AC unit on the ceiling, the most likely cause is a condensate drain line blockage or a leak in the AC unit itself, which falls under the landlord's maintenance duties. Humidity spikes here exacerbate any existing moisture problem. Your first step is to formally notify your landlord or property management company in writing, with clear photos, and request immediate inspection and repair. Under the rental law, they must address issues that affect the property's habitability. Do not attempt to clean it yourself, as improper handling can spread spores. A professional inspection is needed to identify the moisture source and the mold type. While often just a common cladosporium, the only way to confirm it's not the more problematic Stachybotrys ("toxic black mold") is through lab analysis. The remediation process should fix the water leak first, then properly remove the contaminated materials, and finally treat the area to prevent regrowth. Keep records of all communication, as you may need to escalate to the Dubai Land Department if the landlord is unresponsive. |
