Who is responsible for mold remediation cost?« Back to Previous Page

The wall behind our sofa in the living room of our Jumeirah apartment has developed a large black patch of mold. It started as a small spot after the heavy rains in March, but it's definitely spreading and has a really damp, earthy smell. Our landlord says it's our fault for not ventilating properly, but we run the AC constantly. Who is actually responsible for the cost of the mold remediation, the tenant or the landlord?

Responsibility depends on the source of the moisture. Landlords are responsible for structural defects, such as a leaking pipe inside the wall, a crack in the building envelope, or faulty external waterproofing that allowed rain ingress. Tenants are typically responsible for damage caused by internal lifestyle factors, like failing to use the AC appropriately to manage humidity or not reporting a minor leak promptly.

Your situation, with the mold starting after heavy rains and spreading from within the wall, strongly suggests a construction or waterproofing issue. Constant AC use should help control humidity, not cause a damp wall patch. The damp, earthy smell indicates an active moisture source, not just surface condensation.

For a definitive determination, a professional inspection is essential. An expert can use moisture meters and thermal imaging to locate the water's origin without destructive testing. This evidence is crucial for discussions with your landlord. Under Dubai's rental law (Law No. 26 of 2007), the property owner is obligated to maintain the property's condition and ensure it is habitable, which includes addressing structural defects that lead to mold.

Document the growth with dated photos and formally request in writing that the landlord investigate and rectify the issue. If they refuse, you can file a case with the Rental Dispute Settlement Centre in Dubai, presenting the professional inspector's report as evidence. Do not attempt to remediate it yourself, as painting over it or using bleach will not address the hidden moisture, and the mold will return.
