Who is responsible for mold remediation in a rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading in the master bedroom closet. It's on the back wall and seems to be getting worse since the weather got more humid. I’ve told my landlord about the musty smell a few times, but he just says to keep the AC running. Who is legally responsible for the mold remediation and the cost of this in a rental—me as the tenant or the building owner?

Based on UAE tenancy law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the responsibility for structural maintenance and issues affecting the habitability of the property falls squarely on the landlord. This includes mold remediation, as the mold you describe is a direct result of a structural moisture issue, likely a leak or inadequate insulation within the wall cavity, exacerbated by Dubai's high humidity and constant AC operation causing condensation. A landlord's suggestion to simply "run the AC" is an inadequate response to a persistent fungal colony.

Your first step is to formally notify your landlord in writing (email is sufficient), detailing the issue and its suspected impact on your children's health, and request immediate professional assessment and remediation. Keep a record of all correspondence. For a case of this severity, with visible spread and associated health symptoms, a professional inspection is non-negotiable. DIY attempts can exacerbate spore dispersal and health risks. A certified inspector will conduct air and surface sampling to identify the mold species (e.g., Stachybotrys chartarum, commonly called "black mold") and pinpoint the moisture source.

The remediation cost, including the inspection, is the financial responsibility of the building owner. If the landlord remains uncooperative, you may file a complaint with the Rental Dispute Settlement Center in Dubai.

For a certified inspection and a comprehensive remediation plan that addresses the root moisture cause, I strongly recommend contacting our specialists at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an assessment.
