Who is responsible for mold remediation in a rental?« Back to Previous Page

The wall behind the wardrobe in our master bedroom in Jumeirah Village Circle has a huge patch of black mold, which we only found when we moved the furniture to clean. It's been humid for months and I think it's been growing slowly the whole time. My landlord is saying it's our fault for not ventilating properly, but the AC is always on. Who is legally responsible for fixing this and paying for the remediation?

In the UAE, specifically Dubai, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture issue, as outlined in Law No. 26 of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended).

If the mold growth is a result of a structural defect, such as a leaking pipe within the wall, a faulty AC drainage system, or water seepage from the building envelope, the financial and remedial responsibility falls squarely on the landlord. The humid climate and constant AC use can lead to condensation issues if the AC unit is not correctly sized, maintained, or if the property has inherent insulation flaws, which are the landlord's duty to address.

However, if the investigation proves the mold is due to tenant negligence—such as a failure to use the AC appropriately, blocking ventilation grilles, or creating excessive indoor humidity without proper dehumidification—the tenant may be held liable. Merely having the AC "always on" is not sufficient; it must be set to an adequate temperature to manage humidity levels and prevent condensation, especially on cold surfaces behind large furniture.

Given the significant patch you've described in JVC, a professional inspection is critical. A certified mold assessor can conduct moisture mapping and air quality testing to definitively identify the source. This evidence is essential for any dispute with your landlord. Do not attempt to clean it yourself, as improper remediation can exacerbate spore dispersal.
