Who is responsible for mold removal from a hidden leak?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for two years and just noticed a big patch of black mold behind the wardrobe in the master bedroom. It must have been growing slowly from a hidden pipe leak. My wife's allergies have been terrible lately and we're worried it's the cause. Who is responsible for the mold removal and repair costs here, us as tenants or the building management?

Responsibility for mold removal from a hidden leak typically falls on the property owner or building management, as they are responsible for the structural integrity of the building and its main systems, including hidden plumbing. As a tenant, you are generally responsible for reporting the issue promptly and for any damage to your personal belongings.

In Dubai, the tenancy contract is your primary reference. Most standard contracts stipulate that the landlord is responsible for maintenance of the property's structure and major repairs. A leak from a concealed pipe is considered a structural or building envelope issue, not tenant-caused damage. Document everything immediately: take clear photos and videos of the mold and any signs of the leak, and formally notify both your landlord and building management in writing. This creates a crucial paper trail.

Given Dubai's high humidity and constant AC use, mold can spread quickly into wall cavities and the HVAC system, exacerbating health issues like the allergies you've described. Do not attempt to remove it yourself with bleach, as this can aerosolize spores and worsen indoor air quality. A professional inspection is essential to identify the exact moisture source, assess the full extent of the contamination, and provide a verified remediation plan. The responsible party should arrange for both the leak repair by a licensed plumber and the mold remediation by a certified company to ensure it is addressed safely and completely.
