Who is responsible for mold removal in a Dubai rental?« Back to Previous Page

We've been in our Jumeirah Village Circle apartment for about a year, and just last week I found a patch of black mold in the corner of our main bedroom closet, behind some boxes. It seems to be spreading, and the damp smell is getting stronger, especially at night. I’m worried about our health and the damage, but I’m not sure if this is something I need to handle or if it’s the landlord’s responsibility to arrange and pay for a proper mold inspection?

In the UAE, specifically Dubai, the responsibility for mold removal in a rental property is typically dictated by the rental contract and the nature of the issue. The general principle under Dubai Law No. 26 of 2007 (as amended) is that the landlord is responsible for maintaining the property's structure and ensuring it is habitable. This includes addressing underlying defects that cause mold, such as leaking pipes, faulty AC drainage, or inherent construction flaws like water seepage through walls. If the mold growth is a result of such a structural or maintenance issue, the landlord is legally obligated to rectify it, including covering the cost of a professional inspection and subsequent remediation.

However, tenant responsibilities are also significant. You are responsible for maintaining the property in a clean and hygienic condition. If the mold is determined to be a direct result of tenant negligence—such as inadequate ventilation, failing to use bathroom extractor fans, blocking AC vents, or improper cleaning leading to moisture accumulation—the cost of remediation may fall on you.

Given your description of the mold being behind boxes in a closet and the presence of a strong damp smell, this strongly indicates a humidity and condensation issue, which is extremely common in Dubai's climate due to year-round AC operation creating cold surfaces and high ambient humidity. The first step is always a professional inspection to identify the exact species and, more critically, the root moisture source. This certified report is essential to determine liability.

For an accurate assessment and to protect your interests, I strongly recommend contacting a certified professional. Our team at Saniservice can conduct a comprehensive inspection, including moisture mapping and air quality testing, to provide a definitive report for you and your landlord.
