Who is responsible for mold removal in my apartment?« Back to Previous Page

We’ve lived in our Jumeirah Village Circle apartment for two years, but just this winter I started noticing black spots forming along the edges of our bedroom closet. It’s on the wall that faces the outside, and the musty smell is getting stronger, especially when the AC isn't running. Who is responsible for handling and paying for this kind of mold removal, me as the tenant or my landlord?

Responsibility for mold removal depends on the source of the moisture. Under Dubai rental law (RERA), the landlord is responsible for structural repairs and defects in the building’s fabric. If the mold is due to a leaking pipe, faulty external wall sealant, or poor insulation—especially on an outer wall as you’ve described—the remediation cost typically falls on the landlord.

As a tenant, you are responsible for issues stemming from your own use, like inadequate ventilation leading to condensation. Given Dubai’s high humidity and year-round AC use, this is a common cause. The musty smell when the AC is off strongly suggests a humidity or condensation issue.

First, formally notify your landlord or property manager in writing about the problem, including photos. They should arrange a professional inspection to determine the moisture source. Do not attempt to clean significant mold yourself, as improper removal can spread spores. A proper inspection can identify if the issue is a structural leak (landlord's duty) or interior condensation (a shared discussion).

For a persistent issue on an external wall, push for a professional assessment. A certified inspector can use moisture meters and thermal imaging to pinpoint the exact cause, which clarifies responsibility. This is the most effective way to resolve disputes and ensure the problem is fixed correctly, not just painted over.
