Who is responsible for mold removal, landlord or me?« Back to Previous Page

We've lived in our Jumeirah Village apartment for 2 years and just noticed a bunch of black, fuzzy spots spreading in the corner of our master bedroom closet where the outside wall is. It’s gotten way worse since the recent humidity, and I'm worried it's making us sick. Who is responsible for getting this tested and properly removed, me or my landlord?

Under Dubai Law No. 26 of 2007 (as amended), the landlord is generally responsible for maintaining the structural integrity of the property. This includes addressing leaks or seepage from external walls, roofs, or plumbing that cause internal damage like mold. Since you mentioned the mold is on an outside wall and worsened with humidity, the root cause is likely a building envelope issue, which is the landlord's obligation to repair.
Your responsibility as a tenant is typically to report the issue in writing immediately and to maintain adequate ventilation to prevent condensation, a common problem in Dubai's climate where year-round AC use can create cold surfaces for moisture to settle. First, document the mold with photos and send a formal written notice to your landlord or property management company, citing the specific location and its rapid growth. They should arrange for a professional inspection to identify the moisture source—this is critical, as simply wiping it away will result in it returning. If the landlord is unresponsive, you can file a complaint with the Dubai Rental Dispute Center (RDC). For a case with significant spread and health concerns, a proper assessment is needed. An independent inspection can identify the mold type and moisture source, providing a report that clarifies responsibility. Remediation involves fixing the water intrusion first, then safely removing the contaminated materials. Given its location in a closet, personal items may also be affected and require cleaning. |
