Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

We've been living in our apartment in Jumeirah Village Circle for about a year, and just noticed a patch of black mold growing behind the wardrobe in our master bedroom. It's on the wall itself and seems to have spread a bit, probably from all the humidity we've had lately. We're worried about our health and the damage. Who is responsible for fixing this and paying for the mold removal, us as tenants or our landlord?

In the UAE, the responsibility for mold removal is primarily determined by the cause of the infestation, as outlined in standard tenancy contract obligations. The landlord is responsible for maintaining the structural integrity of the property. Therefore, if the mold is a result of a structural defect—such as a leaking pipe within the walls, faulty waterproofing, or a construction issue that allows water ingress from outside—the remediation cost falls to the landlord.
However, as a tenant, you are responsible for maintaining the property in a clean and habitable condition. If the mold growth is a direct result of your lifestyle habits, you would be liable. In Dubai's extreme climate, this primarily relates to inadequate ventilation. Failure to use exhaust fans, not running the AC consistently to control humidity, drying clothes indoors, or placing furniture directly against walls (restricting airflow and creating cold spots for condensation) can all lead to mold, and the resulting damage and cleanup would be your financial responsibility. Given your situation in Jumeirah Village Circle, the location behind the wardrobe is a classic indicator of condensation due to restricted airflow, a common issue in our humid climate where AC is run year-round. However, a professional inspection is critical to definitively determine the root cause. We must rule out a hidden leak from adjacent bathrooms or the external wall. Attempting removal without this diagnosis is ineffective and potentially hazardous. I strongly recommend a certified mold inspection to assess the moisture source and extent of growth. Our team at Saniservice uses thermal imaging and moisture meters to provide a conclusive report on liability and a scope for safe, professional remediation.
