Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

The wall behind our wardrobe in the bedroom has these large black splotches of mold that we just discovered while deep cleaning. We're in an older building in Deira and I'm sure the humidity isn't helping, but we always run the dehumidifier. Who is legally responsible for dealing with this and paying for the removal, us as tenants or the landlord?

The responsibility for mold removal in a rental property in Dubai is primarily determined by the cause of the moisture intrusion, as outlined in Dubai Tenancy Law (Law No. 26 of 2007). As a certified mold inspector, my first technical recommendation is to determine the moisture source, which requires professional investigation.

If the mold growth, such as the black splotches behind your wardrobe, is a result of a structural defect—like a leaking pipe within the wall, a crack in the building envelope, or faulty external waterproofing—then the financial and remedial responsibility falls on the landlord. They are obligated to maintain the property's structure and ensure it is habitable. Conversely, if the cause is determined to be tenant-induced, such as chronic inadequate ventilation, failure to use provided AC systems correctly, or internal moisture generation (e.g., drying clothes indoors without ventilation), then the tenant is liable for the remediation costs.

Given your description of an older building in Deira, high ambient humidity, and consistent dehumidifier use, the cause is likely a combination of factors. The perpetual AC operation common in Dubai leads to significant condensation if drainage systems are faulty or insulation is poor. The wall behind the wardrobe is a classic cold spot where condensation forms, providing the moisture mold needs to thrive on the organic material in the drywall.

This situation necessitates a professional inspection. A certified expert will conduct moisture mapping and thermal imaging to pinpoint the exact source of water, which is critical for determining liability. Attempting removal without addressing the root cause will result in rapid recurrence.
