Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

My kids have been coughing more than usual and I suspect the black mold I just found behind the toilet in our Marina apartment. We've been here almost a year and I'm noticing it's been spreading since the humidity really kicked in last month. Who is responsible for getting this cleaned and treated properly, me as the tenant or the landlord?

In the UAE, the responsibility for mold remediation is typically dictated by the tenancy contract and Dubai Law No. 26 of 2007 (as amended). Generally, the landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or seepage from external walls. These are often the root cause of persistent mold growth in bathrooms, especially in high-humidity coastal areas like Marina.

However, as the tenant, you are responsible for maintaining proper ventilation to control condensation and for reporting any issues promptly. The rapid spread you've observed since the humidity increased is a significant red flag. Given that the mold is behind the toilet, a common location for concealed pipe leaks, the cause is likely structural. Your first step is to formally notify your landlord or property management company in writing, with photographs, and request immediate action. Failure to address a mold issue can be considered a breach of the landlord's obligation to provide a habitable premises.

Due to the potential health symptoms you've described and the spreading nature of the growth, a professional inspection is critical. Our certified inspectors at Saniservice can conduct a comprehensive assessment to identify the precise moisture source (e.g., pipe leak vs. condensation vs. rising damp) and determine liability. We provide a detailed report that can be used to formally engage your landlord. Attempting to clean it yourself with bleach is a temporary fix that will not address the underlying moisture problem, allowing it to return.
