Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

We've lived in this Jumeirah villa for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling, right behind the wardrobe. It's gotten much worse since the humidity spiked last month. My wife has started getting bad headaches and we're really worried about our health. Who is responsible for getting this tested and properly removed, me as the tenant or my landlord?

In the UAE, the responsibility for mold remediation is typically governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. As a certified mold inspector, I can confirm that the landlord is generally responsible for maintaining the structural integrity of the property. This includes addressing issues arising from building envelope failures, such as leaking pipes in the walls, faulty external waterproofing, or inadequate insulation leading to condensation—all of which are common in Dubai's high-humidity climate where year-round AC use can create significant thermal bridging and condensation points.

However, the tenant is responsible for damages caused by their own negligence, such as failing to use the AC to control humidity, blocking ventilation grilles, or not reporting a minor leak in a timely manner, allowing mold to proliferate.

Your situation in Jumeirah, with the mold originating from a ceiling corner, strongly suggests a condensation issue due to a cold bridge or a potential hidden leak from an upstairs bathroom or the roof. The health symptoms you describe are a significant concern and indicate a serious indoor air quality issue that requires immediate professional assessment. DIY removal is not advised for a case of this nature, as improper handling can aerosolize toxins and exacerbate the problem.

Your first step is to formally notify your landlord in writing about the issue, as they are obligated to provide a habitable dwelling. We strongly recommend a professional inspection to identify the precise moisture source and species of mold, as this report will be crucial evidence. For a comprehensive assessment and certified remediation protocol that meets Dubai Municipality standards, I advise you to contact our specialists at Saniservice.
