Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

The corner behind the wardrobe in our master bedroom in Jumeirah Village Circle has turned completely black with mold, and it’s starting to spread to the wall. We’ve lived here for a year and this just appeared over the last few weeks, probably from all the humidity. My landlord is saying it's our fault for not ventilating properly, but we run the AC constantly. Who is legally responsible for paying for the mold removal and fixing the wall, us or the landlord?

In the UAE, specifically Dubai, the responsibility for mold removal hinges on the source of the moisture, as determined by a professional inspection. The sudden appearance of mold behind a wardrobe in Jumeirah Village Circle is a classic symptom of a condensation issue, exacerbated by the region's extreme humidity and the constant cooling from your AC unit. When cold air from the AC meets the warm, humid air penetrating from outside, it condenses on cold surfaces, like the exterior wall behind the wardrobe. This creates the perfect environment for mold growth.

Legally, under standard tenancy contracts, the landlord is responsible for maintaining the property's structure and ensuring it is habitable. This includes addressing issues related to building envelope defects, such as insufficient insulation or hidden water leaks. If our inspection confirms the mold is due to condensation caused by the building's construction (e.g., a cold bridge in the wall) and not tenant negligence, the remediation cost falls to the landlord.

However, tenants are obligated to ventilate the property adequately. Merely running the AC is not sufficient; it must be the correct type (dehumidifying mode) and you must ensure furniture is not pushed directly against walls, restricting airflow.

Given the spread you describe, a professional assessment is critical. We at Saniservice use thermal imaging and moisture meters to pinpoint the exact cause—whether it's condensation, a leak, or both. This detailed report is essential for determining liability. Do not attempt to clean significant mold growth yourself, as improper handling can spread spores and exacerbate the problem. For a definitive diagnosis and a solution that protects your health and your rights, I strongly recommend you call our experts at 800-MOLDS (800-66537) or email hello@saniservice.com for an immediate inspection.
