Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

The ceiling in our master bedroom closet has had a small patch of black, fuzzy mold ever since that big storm a couple of months ago. It’s slowly gotten bigger and now the musty smell is really strong whenever we open the closet door. I’ve told my landlord about it but he says it’s because we run the AC too cold and it’s our problem to fix. Who is actually responsible for getting this cleaned and repaired in a rental, the tenant or the landlord?

In the UAE, the responsibility for mold remediation in a rental property is typically defined by the cause of the moisture issue, as outlined in standard tenancy contract clauses and Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008). The landlord is legally responsible for maintaining the structural integrity of the property. Since your black mold issue originated from a storm-related water intrusion (a leaking roof or ceiling), the repair and subsequent mold remediation are unequivocally the landlord's financial and legal obligation. Their claim that running the AC "too cold" is the cause is a common misconception; in our climate, the AC is essential for controlling the extreme humidity that exacerbates mold growth, not the cause of a roof leak.

The situation you describe—a persistent, growing patch with a strong musty odor—indicates an active moisture source and a significant colonization. This is not a superficial issue. Black mold (Stachybotrys chartarum) can pose health risks and requires professional assessment and remediation. DIY cleaning is not advised as it can disturb toxic spores and fail to address the hidden moisture reservoir.

Your first step is to formally notify your landlord in writing, referencing the storm as the cause. If they remain uncooperative, you may need to escalate the matter to the Dubai Land Department (RDC). For a definitive assessment of the moisture source and extent of contamination, I strongly recommend a professional mold inspection. Our certified team at Saniservice can provide a detailed report with moisture mapping and air quality testing, which serves as crucial evidence for landlords or regulatory bodies. Do not delay, as the problem will only worsen. For immediate consultation, please call 800-MOLDS (800-66537) or email hello@saniservice.com.
