Who is responsible for wall leakage?« Back to Previous Page

After the rain last month, I noticed water seeping into the corner of our bedroom wall, but it only happens when it rains heavily. The landlord hasn't done anything about it even though we brought this up a few months ago. Am I responsible for fixing this or should the landlord be handling it?

In the context of Dubai and UAE regulations, the responsibility for addressing wall leakage issues generally falls under the landlord's purview. The Building Maintenance Law 2015 (Law No. 36 of 2015) clearly stipulates that landlords are responsible for maintaining the building in a good state of repair, including ensuring that all structural components such as walls remain free from defects and damage. This applies to any issues arising due to natural phenomena like heavy rain.

However, it is crucial to conduct an inspection first to determine the exact cause of the water seepage. In your case, since the leakage only occurs during heavy rainfall, it could be indicative of a specific issue that needs professional attention. It's recommended that you engage a certified building inspector who specializes in indoor environmental quality and building sciences for a thorough assessment.

During the inspection, the expert will likely check the following:
• The condition of the exterior walls and any potential weaknesses or damages.
• The integrity of the waterproofing materials used around windows, doors, and other vulnerable areas.
• The effectiveness of the drainage systems in place to prevent water accumulation near the building's foundation.

If it is confirmed that the issue lies with the structural integrity of your property, you should raise this concern with your landlord. It’s important to document all communications and keep records of any discussions or agreements made regarding repairs.

Should negotiations with the landlord not yield satisfactory results, you may consider seeking legal advice to understand your rights under UAE tenant laws. In some instances, you might also be able to claim deductions from rent based on the inconvenience caused by the leaking wall.

Remember that proactive steps can prevent minor issues from escalating into major problems. Regular maintenance and inspections are key to ensuring a healthy living environment in Dubai’s climate conditions.
