Who pays for AC leak mold in rental villa?« Back to Previous Page

The AC in my apartment seems to be leaking water onto the carpet in our second bedroom, and now we’ve got a big black mold patch spreading out from the wall. It’s been slowly getting worse over the last few weeks and the musty smell is really strong. We’re renting a villa in Jumeirah and our contract is a bit unclear about this. Who is legally responsible for paying for the mold removal and repairs here, us or the landlord?

The responsibility for mold removal due to an AC leak in a rental villa is typically on the landlord. According to the Dubai Rental Law (Law No. 26 of 2007), landlords are responsible for maintaining the property's structure and major systems, including the central air conditioning. The AC unit is considered a core fixture, and a leak falls under structural maintenance.
You should formally notify your landlord or property management company in writing immediately. Include clear photos of the leak source and the mold growth. This creates a necessary paper trail. The persistent humidity and condensation from our Dubai climate allow mold to spread rapidly, so prompt action is critical to prevent further damage and potential health issues from the spores. For a large, recurring black mold patch, a professional inspection is essential to determine the full extent of the damage behind walls and under carpets. The landlord is generally responsible for the remediation of the mold caused by the leak and the repair of the AC unit itself. However, if the leak was caused by tenant negligence—such as failing to report a minor issue that then escalated—the cost responsibility could shift. Start by reviewing your tenancy contract's maintenance clause for any specific stipulations. If the landlord is unresponsive, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. |
