Who pays for black mold removal in a rental« Back to Previous Page

The ceiling in my bedroom closet has had a patch of black mold since the heavy rains in Sharjah a couple of months ago, and now it's slowly spreading down the wall. My landlord says it's because we don't run the AC enough, but we keep it at 24 when we're home. Who is legally responsible for the inspection and remediation costs for something like this in a rental?

The landlord is typically responsible for structural repairs, including mold remediation caused by leaks or building envelope issues, which this appears to be. The landlord’s claim about AC usage is a common but often incorrect defense; at 24°C, your usage is sufficient to manage humidity in most Dubai homes. The initial cause was likely water ingress from the heavy rains, a known issue in the region, making it a maintenance problem for the property owner.

For official recourse, document the issue with dated photos and send a formal written notice to the landlord or property management company, referencing the cause. If they refuse, you can file a complaint with the Dubai Land Department’s Rental Dispute Center (RDC) or the relevant municipal authority in Sharjah. They will often side with the tenant if the issue is structural.

A professional inspection is critical here. The mold is actively spreading, indicating an ongoing moisture source. An independent assessment from a company with a microbiology lab can definitively identify the moisture source (e.g., a hidden roof leak, capillary rise) and the mold species, which strengthens your case and ensures the correct remediation is performed. Do not attempt to remove it yourself, as improper cleaning can disperse spores and worsen the problem. The report will serve as your primary evidence for the landlord or any rental dispute.
