Who pays for hidden mold repair, tenant or landlord?« Back to Previous Page

We've lived in our Jumeirah apartment for two years and just noticed a huge patch of black mold spreading behind the wardrobe in the master bedroom. I'm worried it's from a hidden leak in the wall that's been there for ages. Who is responsible for dealing with this and the cost of repairs, me as the tenant or my landlord?

In the UAE, the responsibility for mold remediation and associated repairs is typically determined by the cause of the moisture intrusion, as outlined in standard tenancy contract provisions and Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai.

If the mold is a result of a structural defect, such as a hidden pipe leak within the wall, a faulty sealant on the building envelope, or rising damp due to a construction issue, the financial responsibility for both the repair of the leak and the subsequent mold remediation falls upon the landlord. The landlord is obligated to maintain the property in a habitable condition.

However, tenant liability arises if the mold growth is a direct consequence of their actions or negligence. In Dubai's humid climate, this most commonly occurs due to inadequate ventilation. Examples include overloading a room with humidifiers, failing to use exhaust fans in bathrooms, blocking AC ventilation grilles with furniture (like your wardrobe), or setting the AC temperature too high and turning it off for extended periods, which leads to excessive condensation. If an inspection determines the cause to be lifestyle-induced condensation, the tenant would be liable for the cost.

Given that the mold is significant and located behind a wardrobe, a hidden leak is highly probable. We strongly recommend you immediately contact your landlord and request a professional mold inspection. DIY assessments are insufficient as they fail to identify the precise moisture source. A certified inspector will use tools like thermal imaging cameras and moisture meters to pinpoint the leak's origin and assess the full extent of the contamination.
