Who pays for mold inspection behind wardrobe: landlord or tenant?« Back to Previous Page

The wall behind my wardrobe in our bedroom has started showing these black patches, and it’s been getting worse since the humidity spiked a couple of weeks ago. We’ve lived in this Jumeirah Village Triangle apartment for over a year and never had an issue before. I’m worried it’s a leak in the building’s structure, but my landlord says it’s because we run the AC too high. Who is actually responsible for the inspection and remediation costs for something like this?

The responsibility typically falls on the landlord for structural issues, which this likely is. Black mould behind furniture, especially on an exterior wall, is a classic sign of condensation due to a thermal bridge or a hidden leak, not AC usage. Dubai's high humidity, particularly at night, exacerbates this when warm, moist air contacts the cold wall surface behind the wardrobe.
Tenants are responsible for damage caused by negligence, like failing to report a spill or not using the AC, which is essential for humidity control. However, arguing that running the AC "too high" caused the mould is not scientifically sound; proper AC use reduces humidity. The initial cause must be professionally diagnosed. Your first step is to formally notify your landlord in writing with photos, requesting a professional inspection. Do not attempt to clean it yourself, as disturbing it can spread spores. A proper inspection involves a moisture meter reading to determine if the wall is wet and identify the source. If it's a building envelope issue or pipe leak, the landlord is responsible for remediation under Dubai's rental laws, which mandate that the property is maintained in a habitable condition. If the inspection proves tenant negligence, you would be liable. Given the location and sudden appearance, the burden of proof is on the landlord to show it was your fault. Insist on a diagnostic assessment from a company that provides documented evidence of the moisture source. |
