Who pays for mold remediation, tenant or landlord?« Back to Previous Page

Our apartment in Jumeirah Village Circle has been incredibly humid lately. I just pulled our sofa away from the wall to find a large patch of black, fuzzy mold spreading behind it, which must have been growing for months. We run the AC constantly but the landlord says dehumidifying is our responsibility. Who is legally obligated to pay for the mold remediation and repair of the wall—us or the property owner?

In the UAE, the legal responsibility for mold remediation is primarily dictated by the cause of the moisture issue, as per standard tenancy contract interpretations. The Dubai Civil Code places an obligation on the landlord to maintain the property's structural integrity and ensure it is habitable. If the mold growth is a result of a structural defect, such as a leaking pipe within the walls, a faulty AC drainage system that is part of the building, or water seepage from external walls due to poor waterproofing, the financial responsibility for investigation and remediation falls squarely on the property owner.

However, tenant responsibilities are also clearly defined. If the moisture source is due to the tenant's lifestyle—such as insufficient ventilation, failing to use exhaust fans, drying laundry indoors, or blocking AC units with furniture (like your sofa), which prevents adequate air circulation and leads to condensation—then the cost of rectification may be borne by the tenant. Given Dubai's extreme humidity levels, especially in coastal areas like JVC, constant AC operation is not enough; it must be paired with proper ventilation to manage condensation effectively.

Given your situation, the first step is a professional inspection to definitively identify the moisture source. Our certified mold assessors at Saniservice use tools like thermal imaging and moisture meters to determine the origin without destructive testing. This report is crucial evidence for any discussion with your landlord. We strongly advise against DIY attempts, as improper handling can aerosolize toxic spores.
