Who pays for mold removal in a rented Dubai apartment?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling where it meets the wall. It’s gotten a lot worse since the humidity spiked last month. Who is responsible for getting this professionally treated and paying for it, me as the tenant or my landlord?

Mold remediation responsibility in a Dubai rental typically depends on the cause, as defined by Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai.

If the mold results from a structural issue, like a leaking pipe in the wall, a faulty AC drain line causing condensation inside the ceiling, or water ingress from a roof leak, the financial responsibility for the repair and subsequent mold remediation falls on the landlord. The law obligates the landlord to maintain the property’s basic structure.

However, if the cause is tenant-related, such as inadequate ventilation (e.g., not using the AC to control humidity, blocking vents, or generating excessive indoor moisture without proper extraction), the tenant is likely responsible for the cleanup costs.

Given your description of the mold spreading from a ceiling/wall corner and worsening with high humidity, the cause is ambiguous and requires professional diagnosis. This location is a classic spot for condensation issues, which could be due to poor insulation (a structural flaw) or insufficient dehumidification (a tenant habit).

Your first step is to formally notify your landlord or property management company in writing, with photos, and request a professional inspection to determine the root cause. Do not attempt to remove it yourself, as improper handling can spread spores. A proper assessment will identify if the AC system is contributing to the problem through a clogged drain pan or if there’s a hidden leak. This documented evidence is crucial for determining liability. For health reasons, especially with black mold, a lab test to identify the species is advisable, as this provides concrete evidence of the potential risk and can support your case for urgent remediation.
